OVERVIEW
Welcome to Plab Art & Design (“Plab”, “we”, “us”, “our”). We operate this website and store, together with all related information, content, features, tools, products, and services (the “Services”). Plab is powered by Shopify, which enables us to provide the Services.
These Terms of Service (“Terms”) govern your access to and use of the Services and incorporate by reference our Privacy Policy [LINK], Return & Refund Policy [LINK], and any other policies we post.
By using the Services, you agree to these Terms and our policies. If you do not agree, do not use the Services.
1. ACCESS AND ACCOUNT
You represent you are of the age of majority in your place of residence (or you have parental consent for any minor dependents using devices you own or manage).
You agree to provide accurate, current, and complete information and to keep your credentials secure. You’re responsible for all activity under your account. You may not transfer, sell, assign, or license your account.
2. OUR PRODUCTS (PRINT-ON-DEMAND; VARIATIONS)
Most items are made to order using print-on-demand. Minor variations in color, placement, scale, and print outcome can occur due to device display settings, substrate differences, and production tolerances, these are not defects.
Descriptions, prices, and availability may change at any time. We may limit quantities per person/household/order and may discontinue products at our discretion.
3. ORDERS
When you submit an order, you make an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted when we send an Order Confirmation and process payment.
Please review carefully before submitting; we may be unable to cancel once production has started (common with made-to-order goods).
Purchases are subject to our Return & Refund Policy [LINK]. You warrant purchases are for personal/household use and not for resale or export.
4. PRICES, TAXES, DUTIES & BILLING
Prices may change without notice. The price charged is the price at checkout/Order Confirmation. Unless stated, prices exclude shipping, handling, VAT/sales tax, and, if applicable, customs duties and import taxes.
For deliveries outside your customs area, you are responsible for any import charges collected by carriers or authorities.
You agree to provide valid payment details and authorize us (and our payment processors) to charge your payment method for the full amount, including applicable taxes and shipping.
5. SHIPPING, DELIVERY & RISK
We ship to the address you provide. Delivery dates are estimates only. We are not liable for delays outside our control (carrier issues, customs processing, force majeure).
EU consumer rule: risk in the goods passes to you when you (or a person you designate) take physical possession, except when you arrange your own carrier (not offered by us), in which case risk passes upon handover to that carrier.
If a parcel is undeliverable due to incorrect address or repeated failed delivery, it may be returned; we’ll contact you about reshipment costs.
6. INTELLECTUAL PROPERTY (ARTISTS’ RIGHTS)
All content in the Services, including artworks, images, text, audio/video, graphics, logos, and their selection/arrangement, is owned by Plab or its licensors (including featured artists) and protected by applicable IP laws.
You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly provided. You may not reproduce, modify, distribute, display, create derivative works from, or exploit any content without prior written permission from the relevant rightsholder. All rights reserved.
Plab, associated marks, and product names are trademarks of Plab or its licensors. Other marks are the property of their owners.
7. OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties or endorsement. Your use is at your own risk and subject to the third party’s terms.
8. THIRD-PARTY LINKS
Links to third-party sites/services may appear. We do not control or endorse them and are not responsible for their content, products, or policies. Review their terms and privacy practices before engaging.
9. RELATIONSHIP WITH SHOPIFY
Note: This section is required.
Plab is powered by Shopify, but sales are made directly with Plab. Shopify is not responsible for your purchases or any issues arising from them. You release Shopify and its affiliates from claims, damages, and liabilities related to your transactions with Plab.
10. PRIVACY
Your use of the Services is subject to our Privacy Policy [LINK]. Because we use Shopify, certain personal data may be processed by Shopify and other service providers (which may be located outside your country). See our Privacy Policy [LINK] and Shopify’s privacy documentation for details.
11. FEEDBACK & REVIEWS
If you submit reviews, ideas, or other content (“Feedback”), you grant Plab a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use, host, reproduce, modify, publish, translate, and display the Feedback for operating and improving the Services and for marketing.
You represent you own or control rights to your Feedback; it does not infringe any third-party rights; and any material connection/compensation is disclosed where required. We may monitor, edit, or remove Feedback at our discretion.
12. ERRORS & OMISSIONS
Information on the Services may contain errors or omissions (e.g., pricing, availability, shipping). We may correct, update, or cancel orders affected by such errors, with notice where required by law.
13. PROHIBITED USES
You may not use the Services for unlawful purposes; to infringe IP rights; to harass/abuse others; to transmit malware or spam; to scrape, crawl, or attempt to circumvent security; to misrepresent your identity; or to engage in conduct that harms Plab, Shopify, our users, or the Services. We may suspend or terminate access for violations.
14. TERMINATION
We may suspend or terminate your access at any time for breach or risk to the Services. You remain liable for amounts due up to termination. Sections intended to survive (including IP, Feedback, Disclaimers, Liability, Indemnity, Governing Law, and Dispute terms) survive termination.
15. DISCLAIMER OF WARRANTIES
Except as required by law or expressly stated by Plab, the Services and products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free operation. Implied warranties (merchantability, fitness, non-infringement) are disclaimed to the extent permitted by law. Your statutory rights as a consumer (e.g., conformity guarantees in the EU) remain unaffected.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Plab and its affiliates, partners, directors, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits/revenue/data, arising from your use of the Services or products.
Where liability cannot be excluded, and except for death/personal injury caused by negligence or liability that cannot be limited under applicable law, our aggregate liability for any claim is limited to the amount you paid for the product(s) giving rise to the claim. Your statutory consumer rights remain unaffected.
17. INDEMNIFICATION
You agree to indemnify and hold harmless Plab, Shopify, and our affiliates, officers, employees, agents, and providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of applicable law or third-party rights.
18. FORCE MAJEURE
We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, war, epidemic, governmental action, utility failures, or internet/service interruptions.
19. SEVERABILITY
If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will continue in full force.
20. WAIVER; ENTIRE AGREEMENT
No waiver of any term shall be deemed a further or continuing waiver. These Terms (together with the policies incorporated by reference) constitute the entire agreement between you and Plab regarding the Services.
21. ASSIGNMENT
You may not assign or transfer your rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.
22. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Italy, without regard to conflict-of-laws rules.
Exclusive jurisdiction and venue lie with the courts of Milan, Italy, except that EU consumers may bring proceedings in the courts of their place of residence and benefit from any mandatory consumer protections of that jurisdiction.
EU Online Dispute Resolution: If you are an EU consumer, you may access the EU’s ODR platform for alternative dispute resolution. We are not obliged to participate but will consider reasonable requests.
23. LANGUAGE
If we provide a translation of these Terms, the English version controls in case of conflict, without limiting mandatory consumer rights in your local language.
24. CHANGES TO TERMS
We may update these Terms from time to time. Material changes will be notified in accordance with applicable law. The effective date will be indicated, and continued use after that date constitutes acceptance.
